In a bid to boost recruitment and retention, the Federal Government has introduced a template contract that could save companies tens of thousands of dollars over five years.
The new template contract is designed to provide advice and consultation for both management and consultants and to give the client the flexibility to select their own consultant.
The Government is also introducing a new “consultation agreement template”, which is a guide to how the Government can best support the consultant’s interests in the negotiation of a contract.
The templates are available to businesses through the government’s Consultation Agreements website.
The template contracts are a way for the Government to provide more flexibility to its staff and to ensure that it’s working with the right consultants.
This is important because it allows the Government time to consider what’s most effective for the company and the consultant.
It also allows the government to be able to deliver its own contract for the consultant, which is important for staff and contractors.
But there are some downsides to the new template contracts, according to industry consultant Mark Stuckey.
“They do make things a little bit more complicated,” he says.
“The consultants will need to have specific information on the best way to approach the client and to be ready to provide it, which can be very difficult for some organisations.”
Dr Stucker says there’s also the concern that consultants may not be aware of the requirements of their clients.
“Consultants should be aware that the terms and conditions and contracts that they are working with are important, so they need to be aware, especially if they’re consulting on a client’s behalf.”
Consultants need to know what the contract says about their role and their responsibilities, but the templates are designed to be clear, easy to understand and easy to remember.
It’s important that the templates can be quickly understood and that the contract doesn’t become complicated because of a misunderstanding or the fact that there are different types of contracts.
“I think that if consultants were to have to think about these things a bit more they might be more inclined to take risks and try and do things differently,” says Dr Stackey.
The consultants’ role is also important for the new contract, as it is the client’s responsibility to negotiate the terms of the contract.
“If they’re working on a project that they know the client is happy with and they’re confident that the client will get the best outcome, that might not be the case,” says Mr Stuckeys.
“And I think consultants are more than capable of that.”
If the consultant can’t make an agreement with the client, the contract can be changed, or the consultant may be asked to leave the company.
“There are always things that can happen to the consultant in terms of their contracts, so you can imagine what could happen if there’s a dispute between the client organisation and the consultants,” says Mark Stockeys.
One of the key things that needs to be in the contract, says Dr Mark Stackeys, is the role of the consultant and the roles of the two parties.
“You’re going to need to establish how the consultant will be performing, what will be the work that the consultant is going to do for the client,” he said.
“That’s where the consultant really comes in, because you’re not just doing that for the clients, you’re also doing that to them.”
The Government will be reviewing the consultant contracts soon and will be publishing a consultation document in early February.
“We will be looking at it very closely and we’ll consider any changes in the consultant contract,” says Minister for Industry and the Arts Tony Burke.
The Minister has also said he is looking at whether the Government should use consultants’ expertise to ensure a better result for its clients.
But experts are sceptical.
Dr Stockey says it is important that consultants are provided with the information they need in order to make an informed decision about the best consultant for their role.
“But if you’re looking at a consultant as the person in charge of doing the work, it may not even be clear what they’re doing for the customer,” he explains.
